
EBRD Performance Requirements
The EBRD (European Bank for Reconstruction and Development is financing many projects in Ukraine. The bank requires as part of its loan policy from lenders and their suppliers that EBRD-financed projects are designed and operated in compliance with good international practices relating to sustainable development. The bank has defined and controls ten performance requirements (PR) covering the key areas of environmental and social issues and impacts.
PR 2 - Labour and Work Related Conditions
The performance requirement 2 (PR 2) regulates all questions related to labour and working conditions of employees but also of so-called Non-Employee Workers (Section 19).
Ukrainian suppliers must be aware of the requirements and consequences of none compliance when they contribute to EBRD financed projects.
The PR 2 requirements supplement ILO (International Labour Organisation) conventions, EU policies and local Ukrainian labour regulations.
The goals of the Performance Requirement 2 (PR 2) guidelines are:
- to establish and maintain a sound worker-management relationship
- promote fair treatment, non-discrimination and equal opportunity for workers
- promote compliance with any collective agreements, Ukrainian labour and employment laws and key principals and standards of ILO conventions that are focusing on above points.
EBRD agrees with the lender how project relevant requirements of the Performance Requirements (PR) will be addressed as part of the overall lender's environmental and social action plan.
PR 2 for Non-Employee Workers
Non-Employee workers are engaged staff by the lender through contractors or other intermediaries but also for freelancers who are directly engaged by the lender.
Even though the PR 2 guidelines refer to employees of the lender the applicability of the PR to "non-employee workers" are defined in PR 2 section 19 and covers the following areas:
